On the acquittal of Amanda Echanis

“The Court acquitted her on two grounds:
“1. The evidence – firearm and hand grenade – are fruits of a poisonous tree, therefore inadmissible. The search was in violation of her rights against unreasonable searches and seizures. The searching team conducted the search without any witness and without the presence of the barangay officials. They ordered the occupants of the house to go out while they conducted the search.

“2. Amanda had no actual or constructive possession of the firearm and the explosive. Witnesses testified that she was holding her son while the searching team conducted the search. The sack where the firearms and the hand grenade was not found in her possession or the room where she was staying.” —  Atty. JOBERT PAHILGA, Sentro Para sa Tunay na Repormang Agraryo – SENTRA
